DUI penalties in the state of New Jersey are harsh. However, no matter how bad the situation might seem, there are some steps you can follow to improve your circumstances.

Being arrested for a DUI is never a done deal. Arm yourself with the knowledge in this article to prepare for the worst-case scenario. It could mean the difference between significant financial penalties or even jail time.

Always fight the charges

The legal process for charging DUIs in New Jersey can be complex. You may think your case is hopeless, but that is a huge mistake. Refusing to act and simply accepting the charges will do nothing to help you. Certain factors such as police misconduct or improper blood alcohol content tests can mitigate penalties that you think are certain.

Conduct a private breath test

You might believe refusing a breathalyzer test is a good idea. However, New Jersey legislature follows “implied consent.” This means if you do not submit to a breath test, you will be subject to penalties, including a suspended license and fines. The repercussions might be harsher if you refuse a BAC test. It is in your best interest to submit to the breath test and have a separate private test done. It is within your legal right to do so. Do not assume the test performed by law enforcement is accurate.

A DUI charge is tough to recover from. The best course of action is to take preventative steps before a conviction occurs. Never reveal any information to the arresting officer that might harm your chances, and remember to request a private breath test.
